Arusha, 22 May 2025:<\/em><\/strong> The African Court on Human and Peoples\u2019 Rights (the Court\/AfCHPR) will on Wednesday, 4 June 2025<\/strong>, hold a Public Hearing in the matter of African Commission on Human and Peoples\u2019 Rights <\/em>v Republic of Kenya<\/em>, (Application No. 006\/2012), <\/em>at the seat of the Court in Arusha \u2013 United Republic of Tanzania, from 9:30AM (East African Time).<\/p>\n\n\n\n

The case was brought before the Court by the African Commission on Human and Peoples\u2019 Rights (ACHPR) in 2012.<\/p>\n\n\n\n

In its judgment on the merits, delivered on 26 May 2017, the Court found that the Republic of Kenya had violated several provisions of the African Charter on Human and Peoples\u2019 Rights, and ordered Kenya to, among others, ensure the Ogiek\u2019s access to their ancestral lands, and to implement legislative and policy reforms to protect indigenous peoples\u2019 land rights.<\/p>\n\n\n\n

The Court first set down the matter for a Compliance Hearing on 12 November 2024 but the hearing was adjourned at the request of the Respondent State.<\/p>\n\n\n\n

During the forthcoming hearing, the Court will hear from both Parties on the status of compliance with its judgments on merits and reparations. This hearing is organised by the Court under Rule 81 of its 2020 Rules, as a means to monitor compliance with its decisions.<\/p>\n\n\n\n
