Toutes les informations sur la mani\u00e8re de r\u00e9diger une requ\u00eate sont disponibles sur notre page \u00ab\u00a0<a href=\"https:\/\/www.african-court.org\/afchpr\/progression-dun-dossier\/?lang=fr\">Comment d\u00e9poser une requ\u00eate<\/a>\u00a0\u00bb. La requ\u00eate est d\u00e9pos\u00e9e au Greffe et le Greffier v\u00e9rifie tous les documents.<\/p>\n<p><\/p>\n<p>Lorsque le Greffier a v\u00e9rifi\u00e9 tous les documents n\u00e9cessaires qui ont \u00e9t\u00e9 envoy\u00e9s, il les transmet \u00e0 l&#8217;\u00c9tat d\u00e9fendeur.<\/p>\n<p><\/p>\n<p>Au cas o\u00f9 il manque des documents ou des \u00e9l\u00e9ments de preuve, le Greffier demande au\/\u00e0 la requ\u00e9rant(e) de fournir les informations manquantes.<\/p>\n<p><\/p>\n<p>L&#8217;\u00c9tat d\u00e9fendeur disposera d\u2019un d\u00e9lai de soixante (60) jours pour d\u00e9poser une r\u00e9ponse. Lorsque l&#8217;\u00c9tat d\u00e9fendeur d\u00e9pose sa r\u00e9ponse, celle-ci est ensuite transmise au\/\u00e0 la requ\u00e9rant(e) qui doit d\u00e9poser sa r\u00e9plique dans un d\u00e9lai de trente (30) jours.<\/p>\n<p><\/p>\n<p>La Cour peut d\u00e9cider de tenir des audiences publiques de sa propre initiative ou \u00e0 la demande d&#8217;une partie. La Cour rend son arr\u00eat apr\u00e8s avoir statu\u00e9 sur l&#8217;affaire. Apr\u00e8s le prononc\u00e9 de l&#8217;arr\u00eat, une copie certifi\u00e9e conforme est transmise aux parties, aux \u00c9tats membres de l&#8217;Union africaine et \u00e0 la Commission de Banjul. \u00a0D\u00e8s que les parties, la Commission de l&#8217;Union africaine et les \u00c9tats membres de l&#8217;Union africaine sont inform\u00e9s de la d\u00e9cision, l&#8217;\u00c9tat d\u00e9fendeur est tenu de soumettre p\u00e9riodiquement des rapports \u00e0 la Cour sur la mise en \u0153uvre de l&#8217;arr\u00eat tel qu\u2019exig\u00e9 dans les d\u00e9lais indiqu\u00e9s dans le dispositif.<\/p>\n<p><\/p>\n<p>Les requ\u00e9rants sont \u00e9galement encourag\u00e9s \u00e0 communiquer leurs observations sur l\u2019ex\u00e9cution de l\u2019arr\u00eat. Les parties peuvent demander une interpr\u00e9tation d&#8217;un point sp\u00e9cifique du dispositif de l&#8217;arr\u00eat de la Cour aux fins d&#8217;ex\u00e9cution de l\u2019arr\u00eat.<\/p>\n<p><\/p>\n<p>Toutefois, il appartient \u00e0 la Cour de d\u00e9cider d&#8217;accepter ou non ces demandes. Les parties peuvent \u00e9galement demander le r\u00e9examen d&#8217;une affaire lorsqu&#8217;elles d\u00e9couvrent de nouveaux \u00e9l\u00e9ments de preuve. N\u00e9anmoins, la Cour n&#8217;examinera une requ\u00eate aux fins de r\u00e9vision d&#8217;un arr\u00eat qu&#8217;en cas de d\u00e9couverte de preuves dont la partie n\u2019avait pas connaissance au moment o\u00f9 l&#8217;arr\u00eat a \u00e9t\u00e9 rendu.
