The Legal Aid Scheme is governed by the Legal Aid Policy which was first adopted in December 2012 and as reviewed in 2016. It is managed by the Legal Aid Unit of the Court on behalf of the Registrar of the Court. The funding from the Scheme is currently derived from the Court\u2019s operational budget [comprising assessed contributions of the Member States of the African Union].<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div id=\"e-n-tab-content-8162179422\" role=\"tabpanel\" aria-labelledby=\"e-n-tab-title-8162179422\" data-tab-index=\"2\" style=\"--n-tabs-title-order: 2;\" class=\" elementor-element elementor-element-35e080ad e-con-full e-flex e-con e-child\" data-id=\"35e080ad\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-331dd48d elementor-widget elementor-widget-text-editor\" data-id=\"331dd48d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Article 10(2) of the Protocol to the African Charter on Human and Peoples\u2019 Rights on the Establishment of the African Court on Human and People\u2019s Rights provides that \u201cAny party to a case shall be entitled to be represented by a legal representative of the party\u2019s choice. Free legal representation may be provided where the interests of justice so require.\u201d<\/p>\n<p>Rule 31 of the Rules of the Court (26 June 2020), provides for representation and legal assistance. It states that:<\/p>\n<ol class=\"wp-block-list\">\n<li>\n<ol class=\"wp-block-list\">\n<li>Every party to a case shall be entitled to be represented or to be assisted by counsel and\/or by any other person of the party\u2019s choice.<\/li>\n<li>Pursuant to Article 10 (2) of the Protocol, the Court may, upon request or suo motu, decide to provide, in the interest of justice and within the limits of the financial resources available, free legal assistance to any party at any stage of the proceedings.<\/li>\n<li>The Court shall maintain a Legal Aid scheme for the purpose of implementing this Rule.\u00a0<\/li>\n<li>The Court shall collaborate with the AU Commission in the management of the African Union Legal Aid Fund for African Union Human Rights Organs.\u201d<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p>The Code of Conduct for Counsel appearing before the African Court on Human and Peoples\u2019 Rights which was adopted in November 2018, provides guidance to Counsel on the appropriate conduct towards the Court and their clients in the course of representation before the Court. There is no timeline for application to be on the Roster, therefore applications are received and processed on a rolling basis. The Roster of Counsel can be accessed from the following link<\/p><p><mark>COUNSEL REGISTERED ON THE COURTS ROSTER \u2013 AS OF OCTOBER 2023 &#8211; <\/mark><a href=\"https:\/\/www.african-court.org\/afchpr\/wp-content\/uploads\/2022\/12\/African-Court-Counsil-decembre-2022.pdf\">Download<\/a><\/p><p>The criteria for enrollment of legal professionals to the Roster as provided under the Legal Aid Policy of the Court, is that:<\/p><ul><li style=\"list-style-type: none;\"><ul class=\"wp-block-list\"><li>Counsel must be a national of an African Union Member State;<\/li><li>Counsel must be entitled to practice in any African Union Member State or before international tribunals; and<\/li><li>Counsel must have at least five (5) years of professional experience.<\/li><\/ul><\/li><\/ul><p>The Application form can be accessed at the following link.<\/p><p><strong><mark>APPLICATION FORM TO BE ON THE LIST OF COUNSEL <\/mark><\/strong><a href=\"https:\/\/www.african-court.org\/afchpr\/wp-content\/uploads\/2021\/01\/Application_to_be_on_the_List_of_Counsel_Form.pdf\">Download<\/a><\/p><p>Once Counsel is registered on the Court Roster, they undertake a training conducted by the Court to familiarise them with the procedures before the Court in order to effectively and efficiently represent Applicants. Counsel are selected to represent Applicants from the Roster based on the following criteria:<\/p><ul><li style=\"list-style-type: none;\"><ul class=\"wp-block-list\"><li>geographical location of the applicant;<\/li><li>language of the applicant;<\/li><li>the legal system of the applicant\u2019s case;<\/li><li>the subject matter of the application and specialization of counsel;<\/li><li>availability and willingness of counsel;<\/li><li>availability of funds;<\/li><li>gender considerations;
